What ARE TERMS AND CONDITIONS?

Our refund policy outlines the rules and guidelines regarding refunds for services provided by Jensie Consultants.

 

It forms a legally binding agreement between you and Jensie Consultants, defining the rights and responsibilities of both parties concerning refunds.

Refund Policy

Jensie Consultants (Jensie Consultants Limited) operates in compliance with UK consumer law. Please read our refund policy carefully before making any payments.

 

Application Fees

Application fees, such as the "Flex Plan Application Fee" of £95, are non-refundable under any circumstances.

 

Refunds

We do not offer refunds on any services unless required by UK law. If a refund is deemed appropriate under UK consumer law, it may not be whole. Costs associated with processing the refund, such as transaction fees, processing fees and the costs associated with performing the service, will be deducted from the refund amount. If a refund is required by UK law, you are eligible for it for 14 days.

 

Conditions for Refund Eligibility

  • Fraudulent Applications: We reserve the right to deny service and retain all fees paid if an application is found to be fraudulent or misrepresented.

  • Statutory Rights for Consumers: Consumers' statutory rights under the Consumer Rights Act 2015 are not affected. These rights include the right to services (including digital services) performed with reasonable care and skill, and the right to a refund if services are not as described.

  • Business Transactions: For business-to-business transactions, the Unfair Contract Terms Act 1977 and the Sale of Goods Act 1979 may apply. These Acts provide that goods (including digital goods) and services sold must be of satisfactory quality, fit for purpose, and as described.

Rebate Refund Policy

  • If a refund is required for any project, the rebate amount must first be refunded to Jensie Consultants before any discussions can be made regarding the refund of the project cost.

  • If a refund is made, whether it is a total or partial refund, the rebate is considered to be fully refunded to Jensie Consultants.

Refund Policy for Equity Transactions:

  • Equity transactions are final and non-refundable. By agreeing to an equity share provision, you acknowledge that this is a binding transaction and no refunds will be issued for services provided in exchange for equity.

  • In the event of a dispute regarding the performance or delivery of services provided in exchange for equity, both parties agree to attempt to resolve the dispute through mediation or arbitration before taking any further action.

Refund Policy for Revenue Share Agreements:

  • Revenue share agreements do not involve direct refunds as they are structured based on revenue performance. Payments are contingent upon revenue generated, and adjustments may occur based on the terms outlined in your agreement.

  • Disputes regarding revenue share agreements will follow a similar mediation or arbitration process as outlined in our general terms and conditions.

Project ID Requirement

For the Flex Plan application to be valid, you must have a valid Project ID issued by Jensie Consultants.

 

Communication Responsiveness

You are required to respond to our calls, emails, and communications promptly. This includes but is not limited to:

  • Meeting Attendance: If a meeting is scheduled, you must attend or reschedule within a reasonable timeframe agreed upon by both parties.

  • Email Responses: You must respond to our emails within 72 hours of receipt and provide the requested information or confirmation of receipt with a note of your next actions.

 

Failure to meet these communication requirements may result in the denial of service without a refund.

Notification of Issues

If there are issues with the service for which Jensie Consultants may be liable under UK law, you must notify us within 7 days of discovering the issue. Failure to notify us within this timeframe may affect your eligibility for a remedy.

 

Deductions for Costs

If a refund is processed, any associated costs such as transaction fees and processing fees will be deducted from the refund amount and the costs associated with performing the service
